1. You “the consumer” responsibilities

Under ‘The Fireworks Regulations 2004’;

It is illegal;

  • To sell adult fireworks or sparklers to anyone under 18;
  • For anyone under 18 to possess adult fireworks in a public place

By checking the “I confirm I am 18 years or over and have read the Terms and Conditions (Required)” check box on the Checkout page of the Rugby Fireworks website and purchasing fireworks, you “the consumer” are confirming that you are 18 years of age or over, and that the person who will sign for the delivery of the fireworks will also be 18 years of age or over.

2. Use of fireworks products

  • It is an offence under ‘The Fireworks Regulations 2004’ to let fireworks off during night hours (11pm to 7am), except on Bonfire Night (midnight), Diwali, New Year’s Eve, and Chinese New Year (1am)
  • It is an offence under the Explosives Act 1875 to tamper with or modify fireworks.

In purchasing fireworks from Rugby Fireworks you “the consumer” acknowledge that all fireworks must be used strictly in accordance with the instructions given on the CE mark labels on the individual fireworks, and in compliance with ‘The Fireworks Regulations 2004’ and the UK Firework Code.

3. Privacy Policy

By purchasing fireworks from Rugby Fireworks, you “the consumer” accept the terms of Rugby Fireworks Privacy Policy

4. Price and Minimum Order

All prices are subject to change without notice

All prices shown include VAT at the rate applicable at the time of purchase.

The minimum order is £50 including VAT but excluding delivery charges and discounts

5. Sale and Delivery

Rugby Fireworks is an online retail shop and delivery only service – ‘Click and collect’ is not available.

Delivery is only available to CV21, CV22 and CV23 postcodes in the UK.

Delivery into blocks of flats is not possible.

Your order will be delivered between 5pm and 9pm Monady to Friday or 9am to 9pm Saturday and Sunday on the Delivery Date you “the consumer” selected at the time of purchase. If you need to re-arrange your delivery date you must contact customer-support@rugby-fireworks.co.uk before midnight on the day before your scheduled delivery date.

Delivery will only be made to the shipping address provided (or billing address by default). Delivery must be signed for and cannot be left at a neighbours or another address.

You “the consumer” must provide a daytime telephone number valid for the Delivery Date you have selected.

ALL DELIVERIES MUST BE SIGNED FOR BY A PERSON WHO IS 18 YEARS OF AGE OR OVER.

The person signing for delivery must provide a recognised form of Photo ID if asked to verify their age.

We reserve the right to cancel your order and issue a refund minus a non-delivery charge of £15 if we are unable to deliver for the following reasons;

  • On arrival at the delivery address given the address turns out to be a block of flats
  • A refused delivery – delivery not expected by the person answering the door
  • The person available to sign for the delivery is under 18 years of age or cannot provide a recognised form of Photo ID to verify their age
  • No answer or no person at home to receive an order on your chosen delivery date between 5pm and 9pm

5. Checking your order and Substitutions

Orders contents must be checked within 24 hours of delivery and any issues notified by you to customer-support@rugby-fireworks.co.uk. Rugby Fireworks will try and rectify any issues within 7 days of delivery.

Rugby Fireworks reserve the right to substitute any item with another item that is similar in duration and style and is the same value or greater than the original item. You “the consumer” has the right to reject such substitutions at the time of delivery and Rugby Fireworks will refund the full amount paid for the original item (Note: Refund will be calculated on an ‘after discounts’ basis if applicable). Rugby Fireworks will action a refund within 30 days of the return of the order.

6. Cancellations, Returns and Refunds:

Rugby Fireworks reserve the right to cancel and refund any order at any time.

Under the Consumer Protection (Distance Selling) Regulations, you “the consumer” has 14 days to cancel an order from the date of delivery.

To cancel an order that has not been delivered contact customer-support@rugby-fireworks.co.uk Rugby Fireworks will action a full refund within 30 days. 

If your order has already been delivered, you “the consumer” has 14 days to cancel an order. Your order must be returned to Rugby Fireworks in its original condition (clean, dry and undamaged packaging and labelling) to receive a refund. To cancel an order and arrange collection of the order; contact customer-support@rugby-fireworks.co.uk.  A collection charge of £25 plus the original delivery charge of £15 will be deducted from your total refund. Rugby Fireworks will action a refund within 30 days of the return of the order.

Collection of your cancelled order by Rugby Fireworks is the only option available. As fireworks are classed as dangerous goods they cannot be returned to Rugby Fireworks using standard courier or postal services. Returning a cancelled fireworks order in person to Rugby Fireworks is not possible because the terms of our warehouse lease stipulates no access to the general public.

7. Firework Product Quality and Labelling

All fireworks supplied by Rugby Fireworks are manufactured to comply with BS7114:part 2:1998 and current CE standards

All fireworks supplied are labelled with the CE mark and carry safety instructions on how to set up and use the firework and the minimum safety distances required by regulation.

Duration times given on the website, shown on videos, or marked on the firework label are approximations and a reasonable amount of variation should be expected.

8. Dud Firework Product and Refund

If in the unlikely event a firework fails to go off, or fire completely, please take photos of all sides of the firework including the base and top sides and email them to customer-support@rugby-fireworks.co.uk , and include your name, phone number, order number and the date you tried to set off the firework. Rugby Fireworks will refund the full amount paid for the failed item (Note: Refund will be calculated on an ‘after discounts’ basis if applicable).

Rugby Fireworks will also send instructions on how to dispose of the failed firework safely, or arrange to collect the item from you free of charge.

Please note – fireworks that have failed to go off because they have been allowed to get wet or have been damaged through mishandling, will not be eligible for a refund. Please refer to the guidelines on how to store, setup and fire fireworks.

9. Rugby Fireworks Website

The Rugby Fireworks website may contain inaccuracies or typographical errors. Halo FX Limited make no representations about the accuracy, reliability, completeness or timeliness of the Materials. The use of the Rugby Fireworks website and the products purchased is at your own risk.

10. Limitation of liability

Halo FX Limited and its directors, officers and employees shall not be liable for any direct, indirect, special, incidental, exemplary or consequential damages (including damages for loss of business, loss of profits, litigation or the like) arising out of (a) the use of the Rugby Fireworks website, (b) the content on the website, (c) websites linked to this website and the content, goods and/or services provided therein (d) any decision made or action taken by you in reliance upon the information within, or content of, the site, and/or (e) the inability to use the website and content contained therein (including, but not necessarily limited to, loss of profits, goodwill or savings, downtime, damage to or replacement of programs and data), whether based in contract or tort (including negligence), product liability or otherwise (but excluding claims arising out of personal injury or death) even if advised of the possibility of such damages. Halo FX Limited cannot and does not guarantee continuous, uninterrupted or secure access to the site.

11. Governing law

You “The consumer” agree that these Terms and Conditions are governed by the laws of England and that proper and convenient venue lies exclusively with the English Courts. You agree to be subject to the jurisdiction of the English Courts in the event that any litigation results concerning any aspect arising out of these Terms of Conditions.
